AML Compliance for Real Estate Agents in Dubai: A Practical Guide
AML rules for Dubai real estate agents and brokers: when you are a DNFBP, goAML registration, REAR reports for cash and crypto payments, and KYC on buyers.
Real estate is one of the sectors the UAE treats as a designated non-financial business or profession (DNFBP). Agents and brokers involved in buying and selling property for clients have AML/CFT obligations: registering on goAML, knowing their customers, reporting certain transactions and suspicious activity, and screening for sanctions.
Are you covered?
AML obligations apply to real estate agents and brokers when they carry out transactions for clients involving the purchase or sale of real estate. DNFBP status depends on the activities you actually carry out, not just your licence title.
Core obligations
- Register on goAML, the UAE FIU's reporting platform
- Carry out a business-wide risk assessment and maintain an AML policy
- Identify and verify buyers, sellers and their beneficial owners
- Establish source of funds, especially for cash, crypto and complex structures
- Screen clients against sanctions lists and act immediately on matches
- Report suspicious transactions through goAML
- Appoint a compliance officer and train staff
- Keep records for the period required by law
Real Estate Activity Reports (REAR)
In addition to suspicious transaction reports, agents and brokers must file a Real Estate Activity Report (REAR) on goAML for freehold property purchases and sales involving physical cash of AED 55,000 or more (in a single payment or several), or involving virtual assets, including funds converted from virtual assets. A REAR is a threshold report: it does not replace suspicious transaction reporting.
Crypto in property deals
Payments made with virtual assets, or with money that came from virtual assets, need extra care. Check where the crypto came from, screen the wallets involved with blockchain analytics, and document your source-of-funds review before the deal completes.
Key takeaways
- Real estate agents and brokers handling property sales are DNFBPs with AML obligations.
- File a REAR on goAML for freehold deals with AED 55,000+ in cash or any virtual asset payment.
- Crypto-funded purchases need source-of-funds checks and wallet screening.
